Ch. 105 is concerned with construction within the waters of the Commonwealth (streams, rivers, wetlands, ponds, etc.) While HCCD is not delegated to approve Ch. 105 Water Obstruction and Encroachment Permits, our technician can provide assistance in determining whether you need a permit and can point you in the right direction.

A General Permit is needed for in-stream work in areas draining over 100 acres. Please see Permit Waivers document for exceptions to the general permit. Stream Stats can be used to determine the basin acreage of the area you are working in – please see our technician for assistance.
